Court Restrains Prince Ghandi From Parading Himself As Soun-Elect, Stops Governor, Kingmakers, Others From Further Processes.

An Oyo state High Court sitting in Ogbomoso on Thursday, 7th of September, 2023, issued an interim order to restrain Governor Seyi Makinde and the Kingmakers in Ogbomoso to suspend further processes that may lead to install Prince Afolabi Ghandi Olaoye as the next Soun of Ogbomosoland.

Ghandi, who was earlier announced to have been appointed and approved by the Oyo State Governor as Soun-Elect, together with the Kingmakers were alleged to have failed to abide by the mandatory court injunction already filed before the Court, which restrained and suspended any selection and appointment of the next Soun of Ogbomosoland till the matter already fixed for 3rd of October, 2023 is decided.

The presiding judge, Justice K.A Adedokun, directed the motion of notice of the Interim Order be treated as a matter of urgency and a copy of the order should immediately be served each, to the Governor of Oyo State, The Hon. Attorney General of Oyo State, The Hon. Commissioner for Local Government and Chieftaincy Matters, Ogbomoso North Local Government, Ogbomoso North Traditional Council, all members of the Kingmaker Council and Pastor Afolabi Ghandi Olaoye.

The claimant in the matter is Prince Muhammed Kabiru Olaoye, who is demanding that the Ogbomoso native law that guides installation of Soun, should be strictly obeyed. Having listened to the counsel to the claimant, Abiodun Ogunjimi, Justice K. A. Adedokun held as follows, that:

a) AN INTERIM ORDER is hereby made restraining the 1, 2&3 Respondents either by themselves, agents, servants or officials from presenting any instrument of office in any form of ceremony or issuance of certificate of installation to the 12 Respondent pending the hearing and final determination of the mandatory injunction already filed before this court.

 

b) AN INTERIM ORDER is also made restraining the 12 Respondent from parading, representing and or presenting himself as candidate for any ceremony for the issuance of certificate of installation and or permitted himself to wear any regalia resembling that of the occupant of the stool of Soun of Ogbomoso Chieftaincy pending the hearing and final determination of the mandatory injunction already filed before this court.

 

c) The Claimant/Applicant is hereby directed to serve the Motion on Notice for Mandatory Injunction on all the Respondents in this case. The matter was adjourned to 12 September, 2023 for further hearing of the application.
